Terms of Service

By accessing or using FutureAI (futurai.space), you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. These Terms constitute a legally binding agreement between you and FutureAI. By creating an account, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

You must be at least 13 years old (or 16 in the EU/EEA, or the minimum age required by your jurisdiction) to use FutureAI. By using the platform, you represent and warrant that you meet the applicable age requirement. If you are using FutureAI on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

To access certain features of FutureAI, you must create an account through our authentication provider (Clerk). You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Providing accurate and current information • Notifying us immediately of any unauthorized use We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time through the Data Management page.

You agree to use FutureAI responsibly and in compliance with all applicable laws. Specifically, you agree to: • Provide accurate information in your profile and contributions • Respect other users and engage constructively in community features • Not impersonate other users or entities • Not submit content that is defamatory, obscene, hateful, or discriminatory • Not attempt to manipulate voting, scoring, or gamification systems • Not use the platform for spam, phishing, or malicious purposes • Comply with the terms of service of any AI providers you connect via API keys

You retain full ownership of all content you submit to FutureAI, including ideas, project contributions, challenge entries, forum posts, and Arena-generated content. By publishing content on FutureAI, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make your content available on the platform. This license terminates when you delete your content or account.

FutureAI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform. This license does not include the right to: • Modify, copy, or distribute the platform software • Use automated systems (bots, scrapers) without permission • Reverse-engineer or attempt to extract source code • Use the platform for any illegal or unauthorized purpose • Resell or commercially exploit the platform without authorization

FutureAI allows you to connect your own API keys from third-party AI providers (OpenAI, Anthropic, Mistral, Google, Stability AI, Leonardo AI, Replicate, Kling AI, and custom providers). Regarding API keys: • You are solely responsible for your API keys and any charges incurred • Your API keys are encrypted at rest using AES-256-GCM and never stored in plain text • FutureAI transmits your keys directly to providers and does not log or retain decrypted values • FutureAI is not liable for any costs, damages, or losses resulting from API key use • You must comply with each AI provider's terms of service

The following activities are strictly prohibited: • Attempting to gain unauthorized access to other users' accounts or data • Circumventing security measures, rate limits, or access controls • Uploading malicious code, viruses, or harmful content • Using the AI Arena to generate illegal, harmful, or rights-violating content • Vote manipulation, sock puppet accounts, or artificial score inflation • Harvesting or collecting other users' personal information • Harassment, bullying, or intimidation • Interfering with the proper functioning of the platform Violation may result in immediate account suspension or termination.

Content generated through the AI Arena is subject to the following: • AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all AI outputs. • Ownership of AI-generated content is subject to each AI provider's terms. • FutureAI does not claim ownership of AI-generated content. • FutureAI is not responsible for the quality, accuracy, or legality of AI-generated content.

Your use of FutureAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Our Privacy Policy is available at futurai.space/privacy.

FutureAI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that: • The platform will be uninterrupted, secure, or error-free • Results obtained will be accurate or reliable • AI-generated content will meet your requirements • Third-party AI providers will be available at all times The platform is a collaborative tool for innovation and learning, not professional, legal, financial, or medical advice.

To the maximum extent permitted by applicable law, FutureAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim. Some jurisdictions do not allow certain exclusions. In such cases, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless FutureAI, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of: • Your use of the platform • Your violation of these Terms • Your violation of any third-party rights • Content you submit to the platform • Your use of API keys and third-party AI services

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is harmful to other users or the platform. You may terminate your account at any time through the Data Management page (/data). Upon termination, all your personal data will be permanently deleted. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

FutureAI is accessible globally. By using the platform, you acknowledge that: • You are responsible for compliance with local laws • Content and features may vary by region • Some features may not be available in all jurisdictions • AI providers may have their own geographic restrictions These Terms apply equally to all users regardless of location, subject to additional rights provided by local law.

These Terms shall be governed by applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to mediation or the courts of competent jurisdiction. For EU users: Nothing in these Terms limits your rights under mandatory consumer protection laws. You retain the right to bring proceedings before the courts of your member state.

We may modify these Terms at any time. When we make material changes: • We will update the "Last updated" date • We will notify users via platform notifications for significant changes • We will provide reasonable notice before changes take effect Continued use of FutureAI after changes constitutes acceptance. If you do not agree, please discontinue use and delete your account.
